10,175 Tripartite Indenture made 6 July 25 George II 1751 Between (1) Elizabeth Carslake of Branscombe, widow of John Carslake late of Branscombe, Gent dec’d (2) Henry Carslake of Wiscombe in parish of Southleigh, Gentleman (3) William Carslake of Branscombe, Gentleman [trustee]. It refers to the Will dated 4 April 1749 of her first husband John Carslake and two Leases (one 10 Aug 1715, the other with date not filled in) “under the hand & seal of Joseph Copplestone late of Knightstone in Ottery St Mary Esq since dec’d”. Elizabeth now possesses All that messuage & tenement called Lower Watercombe in Branscombe, formerly in tenure of Joseph Hook dec’d but now in possession of Paul Bartlett as tenant to sd Elizabeth for residue of two terms of 99 years, one determined on the deaths of Joseph Hook of Branscombe yeoman & Susanna now Wife of [blank] Warren of Sidbury, and the other to commence from their deaths & be determinable on deaths of Joseph Holwell of Woodbury, yeoman. Eliz assigns the pprty to William Carslake for the remainder of the terms of years In trust for Eliz until the marriage & from the marr upon trust for Henry Carslake & after his death for Eliz if still living and if not for assigns of Henry Carslake. Eliz is now entitled to an annuity of £50 p.a. payable out of .. Berry Farm in Branscombe .. without any hindrance of Henry’s exors or assigns.
