Will of Ellis Bartlett, [3 Mar] 1618/9
In the name of God, Amen,
I, Ellis Bartlett, of Braunscombe, beinge, thankes be given to God, in healthe and perfecte memorye, doe make these to be my last will and testament as hereafter followeth, viz,
I doe first acknowledge my selfe thankefull unto ye Almightie, not onely for the undeserved stoore of earthlie blessinges bestowed on me, but alsoe especiallie in that he hath vouchsafed in his love to have created me a reasonable Creature in this transitorie worlde, being, I rest assured, by Jesus christ and the holie ghost redeemed and sanctified.
And even soe, prayinge to the Almightie God to give me grace to amend my imperfections and sorrow under the burthen of my greate and heavie synnes committed against his devine maiestie, doe humbly prostrate my selfe before [word missing; marginal note sic in or[igina]li; “thus in the original”] and his mercifull presence, humbly cravinge pardon and forgivenes from and throughe his manifolde graces and mercies,
And even so, commendinge my selfe to that highe God, the furnisher of my faith and Author of my salvation, doe bequeath my bodie to the earth from whence it came, untill it shall please the Almightie my everliving God to raise it up againe and cople it together w[i]th my Soule, to raigne (I rest assured by my steadfast faith in Jesus Christe) in eternall glorye in the kingdome of heaven.
Now, by the leave of my God, I will dispose theis my earthelie blessinges of goodes, landes and tennementes.
Inprimis I give unto the poore people of Braunscomb fortie shillinges.
To the poore of Beare twentie shillinges.
To the poore of Seaton twentie shillinges.
Item my will and true meaninge is that Ann Bartlett my wife shall have the use and occupac[i]on of my dwelling howse in Eastcombe, and tennement thereunto belonging, for such terme as now I have or hereafter may have before and at the tyme of my deathe, if ye said Ann so longe shall live sole and unmaried, and not otherwise, to holde and enioye the same.
Item I give unto my said wife all beastes, sheepe and cattell that shalbe usuallie feade and pastured upon that Tennement, and all such Sheepe, beastes and cattle that shalbe then so fead and depastured upon Foord Grounde, my lande of Hold Norvedge and Myll Meadowe al[ia]s Water Leatch.
Item my will and meaninge is that my said wife shall have the use of all my howsehold stuffe, viz, Bedding, silver plate and all other such necessaries, soe longe as shee shall live sole and unmaryed, and not otherwise.
Item I give unto my brother William Bartlett twenty poundes, which with fowerscoore poundes by me owinge unto him amounteth unto one hundred poundes lawfull English money, to be levyed and paide unto him out of my goodes, landes and chattles.
Alsoe my desire and will is that my said brother William Bartlett shall have meate, drink and lodginge during his life, chargeable upon all my goodes, landes and Chattells.
Item I give all my lande of Hole, with the appurtennances, unto my sonne Ellis Bartlett, and to the heires of his bodie lawfullie begotten.
And for want of such heires I give and bequeath that lande of Hole unto my brother William Bartlet and his heires,
And for want of such heires I give and bequeath the lande of Hole unto Will[ia]m Bartlett, the sonne of Thomas Bartlett of Braunscombe, deceased, and to the heires male of his bodye lawfullie begotten,
And for want of such heires, to whomesoever it shall (by good providence) in right appertaine.
Item my will is that all the proffittes that may arise or grow out of Couchwill at Couchill in Bere and elsewhere, duringe the terme which I now have therein or hereafter may have, excepte twentie poundes p[er] annum thereof assured unto Ann my wife in parte of her Joynture, be whollie imployd (after my debtes and legaceys bee fullie satisfyed and paid) to the use and mainten[au]nce of my sonn Ellis Bartlett.
Item my will is that if my said sonn Ellis Bartlett live unto the full age of one and twentie yeares that then he shall have, of my free guift hereby made unto him,
All the right, title and interest that I now have or hereafter shall procure in Couchwill aforesaid, percell of the manner of Bere, and all my righte, title and interest in my Tennement of Eastcombe, Norvedg and meadow at Waterleath, parcell of the Mannor of Braunscombe, and all my right, title and interest in Ford grounde in Braunscombe (except before excepted) or made in ioynture unto my said wife,
Allwayes provided, if it shall please God to call my sonne Ellis Bartlett from this mortall life before the age of one and twentie yeares, and before marriage and Child lawfullie begotten, that then my will and meaninge is that, of my free guift, by this my last will and testament, my Brother William Bartlett (if he live soe longe) shall have and enioye all my right or rightes aforesaid in all my landes and tennementes, w[i]th mill, meadowe al[ia]s water leates, but otherwise all the rightes thereof to remaine as aforesaid.
Item give unto my sonne Ellis Bartlett one hundred poundes lawfull English money, or soe much as shall remaine when all the legacyes mencioned in this my will are fullie satisfied and paid.
Item I give unto my sister Mary Rippington twentie shillinges.
Ite[m] I give unto my servauntes at my decease twentie shillinges to each of them.
Item I give unto eache of godchildren five shillinges.
Item I give to the bearers of my bodie to the church tenn shillinges,
And to the viccar or minister that shall burye my bodye 10s,
And to the bellringers (if anie bee) tenn shillinges.
The residue of all my goodes and Chattells I give and bequeath unto Ann Bartlett my wife and doe make her my Executrix.
And doe desire and soe ordaine Richard Ducke and Rowland Hewish, Esquiers, Humfrey Duke, and Nicholas Putt, gent, to be my overseers, that by theire good helpe and furtheraunce this my last will and testament may in convenient tyme be accomplished.
Whereas in this my last will I have ordered that Ann Bartlett my wife shall have the use and occupac[i]on of all my howsehold furniture, viz, Silver cupps, with anie other plate, and beddinge and all other necessarie and needfull furniture belonging to my howse, during her widdowehoode and not otherwise, I doe by this my last will (when my said former order therof is performed) give and bequeath all the furniture of my howse unto my sonne Ellis Bartlett.
In Wittnesse whereof I have hereunto sett my hande and Seale the third daye of Marche one thowsand sixe hundred eighteene Anno Regni d[omi]ni n[ost]ri Regis Jacobi Regis Anglie nunc etc decimo sexto [in the sixteenth year of the reign of our Lord King James, now King of England etc].

Codicil to Will of Ellis Bartlett, 1623
Whereas I, Ellis Bartlett, of Braunscomb in the countie of Devon, gentleman, have hertofore made my last will and testament, which I desire that my lovinge wife Ann Bartlett my sole Executrix doe carefullie performe, since which tyme I, the said Ellis Bartlett, have purchased from John Sampsonn of Coliton aforesaid, gent, twoe closes and percells of land and pasture, conteyning by estimac[i]on threescore acres, sometime percell of a tennement called Gatecomb in Coliton aforesaid, for the terme of three hundred yeares from the sixteene of June last past, as by the said deede appeareth, for the disposing of which lease of thre hundred yeares my will and minde is that this may be by waye of Codicill annexed to my foresaid will, vizt,
That my said loving wife Ann Bartlett, my forenamed Executrix, shall have the said landes called Gatcomb for the terme of threescore yeares to commence immediately after my decease (if she shall so longe live sole and unmarried),
And if the said Ann shall happen to marrye within the said terme of threescore yeares, then she, the said Ann, shall enioye the said landes untill Ellis Bartlett my sonne shall accomplishe the age of Fifteene yeares and noe longer,
And then my further will is that from thenceforthe my foresaid lovinge wife Ann Bartlett shall enioy the one moytie of the foresaid landes called Gatcombe for the like tearme of threescore yeares if she shall happen soe longe to live.
And the residue of my foresaid term of three hundred yeares I will and devise by theise presentes unto the aforesaid Ellis Bartlett my sonne.
In wittnesse whereof I have hereunto sett my hand and seale the twoe and twentith daye of September one thowsand sixe hundred twentie three in the presence of theise hereunder written.

[The above-written will was proved, together with a codicil, before the worshipful Sir William Bird, Knight, Doctor of Laws, Master, Keeper or Commissary of the Prerogative Court of Canterbury, lawfully constituted,

By the oath of Ann Bartlett, the relict of the said deceased, and the executrix named in the same will,
To whom was committed administration of all and singular the goods, rights and credits of the said deceased,
She being sworn, on God's Holy Evangelists, before Anthony Turner, Vicar of Braunscombe, by force of a commission issued in that regard, well and faithfully to administer the same etc,
